Effective Date: 01 February 2026

 

These Terms & Conditions govern access to and participation in The Living Room, operated by Motivate Coaching, based in South Africa.

 

By accessing the website, completing the diagnostic quiz, joining any associated Facebook group, subscribing to membership, or participating in any session or workshop, you confirm that you have read, understood and agree to be bound by these Terms.

 

If you do not agree, you must not use or access the services.

 

1. NATURE OF THE SERVICE

The Living Room is a private coaching community built around the Do It Your Way framework.

It provides:

  • Group coaching sessions

  • Monthly workshops

  • Community discussion spaces

  • Reflective tools and materials

  • A diagnostic self-assessment quiz

  • Educational and developmental content

  • The Living Room is an educational and coaching-based environment.

  • It is not therapy.

  • It is not counselling.

  • It is not medical or psychological treatment.

  • Participation is voluntary and self-directed.

  • You remain solely responsible for your decisions, actions, interpretations and outcomes.

 

2. ELIGIBILITY

Membership is strictly limited to individuals aged 18 years or older. By joining, you confirm that:

  • You are legally capable of entering into a binding agreement.

  • You are responsible for ensuring your participation complies with the laws applicable in your country of residence.

 

3. DIAGNOSTIC QUIZ DISCLAIMER

The Living Room quiz is a reflective self-assessment tool.

It:

  • Is not a psychological diagnostic instrument

  • Does not provide medical advice

  • Does not replace therapy, counselling or professional healthcare

  • Is intended for insight and personal reflection only

  • Any interpretation of quiz results is your responsibility.

 

If you are experiencing psychological distress, medical concerns, or mental health challenges, you are responsible for seeking qualified professional support in your jurisdiction.

 

4. MEMBERSHIP STRUCTURE

Membership operates on a rolling monthly subscription basis unless otherwise specified.

Fixed-term options may be introduced at management’s discretion.

Access includes:

  • Two weekly group coaching sessions (not recorded)

  • One monthly workshop (recorded)

  • Access to the Members Lounge Facebook group

  • Relevant materials and updates

  • Management reserves the right to modify scheduling, format or structure where reasonably necessary.

 

5. PAYMENT TERMS

Membership fees are payable in advance.

By subscribing, you authorise recurring monthly billing unless cancelled in accordance with these Terms.

Failure of payment may result in suspension or termination of access.

All prices are subject to change with reasonable notice.

 

6. REFUND POLICY

As a general rule, fees are non-refundable.

If a member cancels after payment has been processed, access remains available until the end of the paid period.

Refunds may be granted only:

  • Upon written request

  • At the sole discretion of management

  • Confirmed in writing

  • No automatic refund rights apply.

 

7. RECORDINGS & CONTENT USE

  • Weekly group coaching sessions are not recorded to preserve privacy and psychological safety.

  • Monthly workshops are recorded.

  • Workshop recordings:

  • Are shared within the Members Lounge

  • May include educational segments presented by coaches

  • May be edited for marketing purposes

  • No member contributions will be used for marketing without explicit written consent.

  • By participating in workshops, you consent to recording of presenter-led content.

 

8. COMMUNITY CONDUCT

Members agree to:

  • Engage respectfully

  • Maintain confidentiality of other members

  • Not share private discussions outside the community

  • Not promote or solicit within the group

  • Not reproduce or distribute proprietary materials

  • Management reserves the right to:

  • Remove content

  • Suspend or terminate membership

  • Restrict access

  • Without refund if conduct breaches these Terms.

 

9. INTELLECTUAL PROPERTY

All materials, frameworks, language, structures, recordings and content are the intellectual property of Motivate Coaching.

Members may use materials for personal development only.

Reproduction, distribution, resale or adaptation is prohibited without written permission.

 

10. PERSONAL RESPONSIBILITY

You acknowledge that:

  • Outcomes are not guaranteed

  • Coaching is a collaborative, non-directive process

  • Decisions made following participation are your responsibility

  • You assume full responsibility for:

  • Business decisions

  • Relationship decisions

  • Financial decisions

  • Health decisions

  • Lifestyle changes

  • You participate at your own risk.

 

11. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law:

Motivate Coaching, The Living Room and its facilitators shall not be liable for:

  • Indirect loss

  • Consequential damages

  • Loss of income

  • Emotional distress

  • Business losses

  • Personal losses

  • Total liability shall not exceed the amount paid by the member in the preceding 30 days.

  • Nothing in these Terms excludes liability where such exclusion is unlawful under mandatory local law.

 

12. INDEMNIFICATION

You agree to indemnify and hold harmless Motivate Coaching and its representatives from any claims, losses, damages or liabilities arising from:

  • Your participation

  • Your decisions

  • Your misuse of materials

  • Your breach of these Terms

  • This indemnity survives termination of membership.

 

13. PRIVACY & DATA USE

We are committed to responsible handling of personal information in accordance with applicable data protection laws, including the Protection of Personal Information Act (POPIA) in South Africa and, where applicable, the General Data Protection Regulation (GDPR).

 

13.1 Data We Collect

We may collect and process the following personal data:

  • Name
    • Email address
    • Billing address (where required)
    • Payment information (processed securely via Stripe — we do not store full card details)
    • Quiz responses
    • Session attendance data
    • Community participation data
    • Correspondence submitted to us

 

13.2 How We Use Your Data

We process personal data for the following purposes:

  • To provide membership access

  • To deliver coaching sessions and workshops

  • To administer the diagnostic quiz

  • To communicate membership updates and service-related information

  • To manage billing and payment processing

  • To improve the quality of services

  • To comply with legal obligations

We rely on:

  • Contractual necessity (to deliver membership services)

  • Legitimate interest (service communications)

  • Consent (marketing communications, where applicable)

 

13.3 Third-Party Processors

We use trusted third-party service providers to deliver aspects of the service:

  • Stripe — payment processing

  • Zoom — session hosting and attendance data

  • Facebook (Meta) — group hosting and community access

  • Email service providers — communication distribution

 

Each provider operates under its own privacy policy.

We are not responsible for the independent policies of third-party platforms.

 

13.4 Data Retention

We retain personal data only for as long as reasonably necessary to:

  • Fulfil the purposes outlined above

  • Comply with legal and accounting requirements

  • Resolve disputes

 

Membership data may be retained for administrative, legal or audit purposes after cancellation.

 

13.5 Your Rights

Depending on your jurisdiction, you may have the right to:

  • Request access to your personal data

  • Request correction of inaccurate data

  • Request deletion of your data

  • Object to processing

  • Withdraw consent (where processing is based on consent)

We will respond within a reasonable timeframe in accordance with applicable law.

 

13.6 Marketing Communications

Where you have opted in, we may send you marketing communications related to Motivate Coaching services.

 

You may unsubscribe at any time using the link provided in emails or by contacting us directly.

Service-related communications (e.g., membership updates, billing notices) are not considered marketing and may be sent where necessary for contractual performance.

 

13.7 Data Security

We take reasonable technical and organisational measures to safeguard personal data.

However, no online system can be guaranteed to be completely secure.

 

You are responsible for maintaining the confidentiality of your login credentials and managing your own online privacy.

 

14. CONFIDENTIALITY LIMITATIONS

While we aim to foster a confidential environment:

  • We cannot guarantee the conduct of other members

  • Facebook operates under its own policies

  • Members share information at their own discretion

  • You are responsible for what you disclose.

 

15. TERMINATION

You may cancel membership at any time before the next billing cycle.

Management may terminate access for breach of Terms.

No refund is guaranteed upon termination.

 

16. GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. However, members remain responsible for complying with any mandatory laws applicable in their own jurisdiction.

Nothing in these Terms limits statutory rights that cannot lawfully be excluded under local law.

 

17. MODIFICATIONS

We may update these Terms from time to time.

Continued participation constitutes acceptance of revised Terms.

 

18. ACCEPTANCE

By:

  • Completing the quiz

  • Subscribing to The Living Room

  • Joining the Facebook groups

  • Participating in sessions

 

You confirm that you:

  • Have read these Terms

  • Understand them

  • Agree to be bound by them
